Overview

The County Clerk's office maintains records on civil suits filed for
$500 or less in Montgomery County Courts at Law. We also
maintain records on cases that are appealed from the Justice of the Peace
Courts. The District Clerk handles civil filings in amounts greater
than $500, family matters including divorce, condemnations and all Juvenile
cases. |

Please provide separate checks for filing fees and for the service
fees. The check for filing fees may be made to Mark Turnbull, County
Clerk.

SEC. 25.1722 (e) Government Code.
The district clerk of Montgomery County serves as clerk of the county courts at law in cases of concurrent jurisdiction
between the district courts and the county courts at law
and shall establish separate dockets for the county courts at law.
The county clerk serves as clerk of the county courts at law in all other cases.

The Texas Supreme Court has adopted revisions to Rule of Civil Procedure 78a, which requires that a civil case information sheet accompany the filing of: 1) an original petition or application; and 2) a post-judgment petition for modification or motion for enforcement in a case arising under the Family Code. The revised rule will take effect September 1, 2010.
