359th SETTING POLICIES


TRIAL SETTINGS:
Trial Settings are obtained by filing a completed “Request for Trial Setting” with the District Clerk.

MEDIATION REQUIRED:
All civil cases are required to complete mediation prior to trial. All family cases are required to complete mediation before any temporary orders hearing and again before any final orders/trial.

MOTION SETTINGS/SUBMISSION DOCKET:
All contested motions are set first on the Submission Docket. Submission dockets are held Mondays and Wednesdays at 9 a.m. and must be set with at least 10 days notice unless additional notice is required by the Texas Rules of Civil Procedure. Parties are responsible for noticing their own motions for the submission docket. Certificates of Conference must be included with every motion.

ORAL HEARINGS:
An oral hearing will only be had after the motion is first considered on the submission docket, and only at the request of a party, unless otherwise directed by the Court.

TRANSFERRED CASE SETTINGS:
All cases with active settings that are transferred from any other court to the 359th must have their settings re-set. It is the parties' responsibility to ensure that settings are obtained.

E-FILE TRANSFERRED CASES:
Any case designated as an e-file case that is transferred to the 359th, will be de-designated as an e-filing case.  Please begin filing all pleadings via hard copy with the District Clerk.

E-FILE TRANSFERRED CASES SUBMISSION DOCKET ONLY:
Any case designated as an e-file case with a pending submission must e-mail the submission notice to gwendolyn.simpson@mctx.org in order to ensure that the submission is brought to the Court's attention.


NOTICE TO ALL PARTIES:
All settings are given with the intention that they be reached on that particular day. If the parties reach an agreement to continue or pass a setting, please advise the court coordinator immediately, so that the time slot may be given to another case.
